The Macau government has initiated a public consultation to overhaul its advertising licensing framework, seeking input from various sectors. The month-long review, spearheaded by the Director of the Economic and Technological Development Bureau, Yau Yun Wah, aims to modernize the outdated “Advertising Activities Law,” enacted in 1989.
Streamlining Advertising Regulations
The primary objective is to streamline the advertising licensing process, making it more efficient and responsive to contemporary needs. The consultation document proposes significant changes, potentially impacting various industries, including the gambling sector. A key aspect under consideration is a potential prohibition on advertising gambling activities. However, the precise impact on gambling advertisements remains uncertain until the consultation period concludes in August.
Impact on Gambling Advertising
While the review encompasses broader advertising regulations, the potential implications for gambling advertising are significant. The current regulations, in place for 35 years, are considered inadequate in light of advancements in advertising technology. Although current laws permit gambling operators to advertise, strict stipulations prevent the games themselves from being the central focus of the advertisement. Limited exceptions currently exist for certain forms of gambling, such as lotteries and football betting authorized under the Gambling Tax Act. The proposed amendments could alter these exceptions.
Public Participation
The government encourages widespread participation in the review. Individuals can contribute by attending one of five scheduled consultation meetings or submitting their feedback remotely using the provided consultation document. This comprehensive review aims to create a more modern and efficient regulatory environment for advertising in Macau, aligning it with current technological advancements and the government’s broader policy goals.
