The UK Gambling Commission to Enhance Penalty Calculation Process
The Gambling Commission (GC) will release updated guidance on October 10th, 2025, outlining revised procedures for levying financial penalties against gambling operators. This update follows extensive industry consultations aimed at streamlining the penalty process and improving transparency.
The revised guidelines, effective October 10th, 2025, stem from consultations conducted since 2023, focusing on amendments to the Statement of Principles for Determining Financial Penalties (SoPfDFP). The consultation, concluded in March 2024, resulted in significant changes to the penalty calculation methodology.
John Pierce, the GC’s Director of Enforcement and Intelligence, stated that the changes will “strengthen our decision-making and streamline the calculation of penalties – helping to improve the efficiency and effectiveness of our enforcement work.” The improvements center on increased transparency, clearer processes, refined assessment factors, and defined starting points for penalties.
Clarified Penalty Calculation Methodology
The updated SoPfDFP will clearly detail a seven-step process for assessing and imposing fines. This structured approach aims to enhance fairness and consistency in the application of penalties. A key element involves a five-tiered severity scale to categorize breaches based on their seriousness.
Determining the initial penalty amount will now involve a combined analysis of the breach’s severity level and a percentage of the operator’s Gross Gambling Yield (GGY). However, this GGY-based calculation will exclude society lotteries and external lottery managers. The final penalty amount will be adjusted based on defined aggravating and mitigating factors.
Industry Consultation and Exemptions
The GC’s consultation received responses from 29 industry entities, with 21 consenting to be named in the report. These entities addressed 61 questions related to the proposed changes. The updated guidance explicitly exempts society lotteries and external lottery managers from the GGY-based penalty calculation.
Focus on Compliance and Consumer Protection
Mr. Pierce emphasized that the revised approach “encourages compliance at the earliest opportunity, supporting the protection of consumers alongside fair and proportionate outcomes for operators.” This focus on early compliance underlines the GC’s commitment to both protecting consumers and ensuring fair treatment of licensed operators.
