The Netherlands’ Kansspelautoriteit (KSA) has levied its first penalty against a YouTube influencer for promoting unlicensed online gambling. LeftlanePapi was targeted for posting videos featuring live streams of gambling on unauthorized platforms. The KSA determined this content constituted active advertising, urging viewers to participate.
After issuing an initial warning and a 48-hour deadline for content removal, LeftlanePapi failed to comply, triggering the penalty.
KSA’s Enforcement Policy
The KSA’s response highlights its two-pronged approach to influencer-driven illegal gambling promotion. A violation triggers an immediate warning, demanding content removal within 48 hours. Non-compliance results in a formal order, subject to substantial fines.
The regulator emphasized the severity of the issue, stating that failure to remove existing content and cease further promotion will incur a penalty of €25,000 per violation, with a maximum penalty capped at €75,000.
